The Equitable Representation Law Stalled Before the Vote: Two Albanian Parties, One Badinter Majority

The draft law on equitable representation is stuck. It did not fall at a vote - it never reached a vote. It is waiting for Parliament Speaker Afrim Gashi to put it on the agenda, and he has not done so.

The reason is arithmetic. Adoption requires what is known as the small Badinter majority - support from a majority of the MPs present who belong to communities that are not in the majority. The opposition DUI claims it holds that majority.

„We will be waiting for it, and it will not pass”

MP Ilir Hasani was explicit from the parliamentary press room: „We are persistent in defending our position that this law should not pass. As the opposition we have the Badinter majority, so the equitable representation law is currently left behind closed doors, waiting for a convenient moment to be smuggled through. We will not allow that, just as we have not allowed it before. If the Speaker puts it on the agenda, we will outvote it and this law will not pass.”

The word he chose was „smuggling”. That is an accusation that the government wants to slip the law through without a real debate. The governing „Vlen” responded that with this blockade DUI is placing itself directly against the principles of the Ohrid Framework Agreement, and that it wants to create the impression that Albanians' rights are under threat.

Same subject, opposite sides of the bench

What makes the dispute interesting is not the content of the law but the symmetry. DUI, which carried the representation issue for decades, is now blocking the legal framework for it. „Vlen”, which came to power promising a systemic fix for representation after the „balancer” was scrapped, now cannot gather the votes for its own proposal.

Two parties speak in the name of the same community and accuse each other of damaging it. The Badinter mechanism, designed as protection against majoritarian rule, is working here as a handbrake in an internal settling of accounts between two Albanian parties.

Who is left waiting

Mickoski said he does not expect these legislative disputes to become a ticket to early elections, and that the government has prepared the laws - responsibility now sits with the MPs.

Parliament is heading into its summer recess. The law that was meant to regulate representation in public administration stays behind a closed door - not for lack of arguments, but for lack of votes. And the people waiting for a job under that law are still waiting.
