The prediction markets platform Kalshi sent Netflix a cease and desist letter on Friday - demanding it pull the trailer for an upcoming documentary. In the letter Kalshi claims the trailer is „defamatory” and contains „both fabricated documents and false and misleading statements”. This is a company that lives off people putting money on uncertain outcomes, now demanding that a streaming service guarantee certainty in a trailer.
The documentary „Instadocs: The Prediction Games” is about the rise of prediction markets and, according to Netflix, features interviews with the chief executives of the two biggest firms in the business - Shayne Coplan of Polymarket and Tarek Mansour of Kalshi. So the company had the camera in front of it, sat down and talked. The problem is not the documentary. The problem is the trailer.
Where the dispute sits
The trailer focuses on a party in Las Vegas where men gathered who had, as claimed, made millions of dollars on prediction markets - „probably eight figures, just during the World Cup” - to watch the final together. One of the guests says: „I like betting on Kalshi.” Another shows a 5,000 dollar bet on his phone.
Here is the knot: Kalshi is currently banned from operating in Nevada because of a court ruling. The company claims the bet on screen is in fact a picture of a transaction made on 16 May 2025 - long before the ban. In its telling, Netflix „misled its millions of users into believing this man successfully traded sports event contracts in Nevada on 19 July 2026”.
Netflix does not dispute the date. A spokesperson told The Hollywood Reporter that none of the footage was fabricated: „The footage was filmed at the Winible World Cup Watch Weekend in Las Vegas on 17 July 2026. The trader shown with the Spain transaction showed us a picture of his bet, which was placed in May 2025 before any court ruling in Nevada. Any specific transactions or bets mentioned during that weekend are a matter between the individual and the app they made them on.”
What is worth noting
Both sides are right about the same image. The bet is real and it is from 2025. The Nevada ban is real and it is from 2026. The trailer puts them side by side and leaves the viewer to assemble a conclusion that is not accurate - without uttering a single untruth. That is editing, not lying, and it is an old craft of cinema.
What makes the story interesting is who is complaining. Prediction markets defend their entire legitimacy with the argument that they are not gambling but information trading - a serious financial instrument. But when the camera catches their users as men at a party in Vegas showing five-thousand-dollar bets on a phone, the firm suddenly discovers it has a problem with context. There is nothing in that trailer that Kalshi did not enable itself.
Kalshi also claims it spoke with a Netflix employee who agreed the image would not appear in the documentary itself, but that the company „inexplicably refused” to remove it from the trailer circulating on the app's home page. Whether the letter achieves anything before the premiere is a bet on which, ironically, somebody has probably already put money.
